Thank you for the correction. However someone else already sent me that
correction. I thanked that person for the correction too. However, I
feel compelled to that I really appreciated that person's kindness
because they sent me their gentle correction off list. It was far less
embarrassing. Although I was still kicking myself for not having taken
the time to make sure that I had the correct word. Unfortunately, I was
in too much of a rush to get back to work on my primary research
project, i.e. compiling a community history of the civilian population
of the Saratoga Tax District of Albany County, NY between 1764 and
1777. So rest assured that I have learned a lesson. All I can ask is
that you forgive me for my typographical errors, misspellings and
incorrect word usages.

Leslie Potter

Here is what I found
> at page 306 thereof:
>
> JAIL - Etymologically, a jail is a 'little cage.' The word comes
> ultimately from Vulgar Latin *gaviola, which was an alteration of an
> earlier *caveola, a diminutive for of Latin cavea 'cage' (source of
> English cage). It passed into English in two distinct versions: jail
> came vial Old French jaiole; but the Old Northern French form of the
> word was gaiole, and this produced English goal. Until the 17th century
> goal was pronounced with a hard /g/ sound, but then it gradually fell
> into line phonetically with jail. There has been a tendency for British
> English to use the spelling goal, while American [English] perfers jail,
> but there are now signs that jail in on the increase in Britain.
>
> Words are definitely fascinating.
>
> Leslie Potter
>
> -------------------------------
> To unsubscribe from the list, please send an email to
> PAGENWEB-request@rootsweb.com with the word 'unsubscribe' without the
> quotes in the subject and the body of the message

An arrest warrant is issued "for" a person not "to" a person. There are
a number of different circumstances under which an arrest warrant could
have been issued for a person. Those circumstances range from the
commission of a felony to the commission of a misdemeanor to contempt of
court or failure to appear for a court hearing. Warrants issued for the
later two causes are usually called "bench warrants", but will still
lead an arrest of the person named in the warrant.

The note that the Sheriff "brought the body in" only indicates that the
Sheriff was was successful in arresting the person named in the warrant.

The Sheriff probably incarcerated the person, who was named in the
arrest warrant, until such time as he could be brought before the
court. "Goal" is one of the old fashioned words for jail.

You will probably want to read the Clerk's docket book for the Court of
Oyer and Terminer and/or the docket book for the Court of Quarter
Sessions. In the 18th century there were two separate courts which had
jurisdiction over criminal matters. There were several other courts
which could have issued a warrant in a civil proceeding.

18th century legal idioms can be difficult to deal with.

I suspect that it would be worth your while to hire a researcher in
Bucks County to look at the original court records for you. Since I
have never practiced in Bucks County, I have no idea how many of the
original court records still exist or where they might be located.
However, I have always found that the information found in old court
record to be worth the effort to track these documents down.

Leslie Potter
Glen Mills, PA
