Just to offer another point of view, I consider myself an independent contractor, not an employee. My client does not pay or contribute towards my health benefits, social security, pension, or make any other payroll deductions for me that may be required under federal or state laws. My client pays me a commission, not a paycheck.
As far as copyright issues, Sharon DeBartolo Carmack wrote an interesting article within the last year or so in either the APG Quarterly or FGS about being taken to court by a client. Her article might clear or muddy the waters, depending on your point of view.
