The USPTO site is where anyone can search for
trademark names. See http://www.uspto.gov I am not a
trademark attorney but this is a simple search
question. Nothing mysterious in this case as far as I
can tell.
Heritage Quest as a trademark was filed for on 24 Aug
1998 and registered 5 Sep 2000. Part of the trademark
process is an examination of other trademarks in the
same goods and services for anything too close. Once
that is OK then the mark is registered as in this
case. (Of course, later another party can still
sue/petition that another's trademark is confusing in
the same goods and services.)
The mark's owner is listed as American Genealogical
Lending Library DBA Heritage Quest Corp, Utah. This
information matches that on the company's home page.
So nothing mysterious.
As for ProQuest...UMI did have "Pro Quest Direct"
trademarked for a while but abandoned it. The
trademark Pro Quest that is still "live" was filed 23
May 2000 and then registered 19 Aug 2003. Thus,
according to the government's database Heritage Quest
is older.
