I have a different variation of Ernest's question. Can the society that
published his articles as hard copy then publish the same article in an
electronic format, either on the Web or on a CD, without violating his
copyright? Or does the society need to obtain a copyright release from him?

Jeanne-

It depends upon the nature of the agreement they made--or the terms of their
stated policy. For instance--to use RootsWeb as an example--the publicly
posted AUP gives RootsWeb/Ancestry the right to redistribute which covers the
right to archive mailing list messages and to distribute message board posts
to a gatewayed mailing list. In general, the right to publish an article
would include the right to redistribute in the manner you list above.

Another example would be submitting a GEDCOM (although GEDCOMs don't always
include much copyrightable content) to WFT for inclusion in the CDs--by
submitting the GEDCOM you are giving WFT the right to use the data in their CDs.
You don't, however, give up your own rights over the content that may be
copyrightable.
