The probate file I'm citing was originally a will when petitioned for probate however the surety for the executors' bond was one of the decedent's sons and an heir. He petitioned the court to be released as the surety because he felt it was a conflict of interests to be the surety and an heir. The judge released him as surety and released his brother who was the executor from his bond. Then he appointed him as administrator with an unrelated person as the surety and annexed the will to the estate.
Do I cite this as it originally was as testate or intestate it became during the petition hearing"? My student number is #25043. Thanks.
