Douglas' proposition aside, how about - he lied!

You don't state the full details, but I gather the offence was in Newcastle
and the application for the land grant was in VDL. How were the officials
in VDL going to discover whether he had committed an offence elsewhere?
Which place were they going to search first? Communications were difficult
at the best of times and extremely time-consuming. And the record keeping
was not totally consistent.

I think your man probably knew that he could/would not be traced easily and
told a fib.
