Not being a lawyer I cannot speak with any kind of certainty but common
sense tells me that if S-13 fails to pass at this sitting our legal
challenge would have a stronger argument. Wouldn't any Judge have to make
his ruling based on the current laws on the books not those that might come
into effect in the future and isn't Mr. F mandated to follow the laws of the
land. If this is correct then please let the bill die and give us our
census.

An opt-in/out clause diminishes the value of any future census records. It
would be far more difficult to have that opt-in/out clause removed.
