Cemetries in Victoria are covered by the Cemetries Act which was
recently reviewed but the recommendations of the Advisory Committee not
released. If you are worried about a particular cemetery write to the
relevant cemetery trust. There is often a Friends group for an old
cemetery - or contact the local historical society. Cemetery boards
would prefer to be free to commercially redevelop areas of old graves.
Basically the original legislation in the 1860s was very progressive
moving away from the European idea of sepaerate churchyard cemeteries
for each denomination to the idea of a public cemetry in each locality
which would be governed by a board representing the different
denominations. The idea was that purchasing of a grave would enable the
'owner' to up to three interments on the one plot and the funds would go
into a fund for the upkeep of the cemetery. Unfortunately over time some
areas became de-populated & there were insufficient further graves
purchased to provide for upkeep. In other cemeteries families have
become un-caring. In other states legislation has been changes to
encourage recycling of grave sites unless descendents pay a further fee
every 25 years or so - as is required with niches where ashes are
stored.
