Last Will and Testament of Benjamin Hazel- August 2, 1831
In the name of God, Amen. I Benjamin Hazel of Kent County in
the State of Delaware, being weak in body but of sound mind,
memory and understanding; considering the certainty of death
and the uncertainty of the time thereof and being desirous to settle
my worldly affairs and thereby be better prepared to leave this world
when it shall please God to call me hence, do therefore make and
publish this my last will and testament in manner and form following
viz.
I give and bequeath to my daughter Ann Hurlock, wife of Isaac
Hurlock, in the state of Indiana the sum of twenty five dollars, which said
legacy or sum of money , I will and order, shall be paid to the said
respective legatee within three years after my decease, without
interest which is to be in full for her part of my estate.
Item: I give and bequeath to my son George Hazel and William Hazel
and their Heirs all my meffuage or tenement's situated lying and
being in the county and state aforesaid, together with all my other
free hold estate whatever, to hold to them, the said George Hazel
and William Hazel their heirs forever (or down to the later posterity
of heirship) to be equally divided between them. And as to all the
rest, residue, and remainder of my personal estate, goods and
chattle of what kind and nature dower, I give and bequeath the same
to my two sons, George Hazel and William Hazel with the exception
of fifty dollars, which Willliam shall have more than George as an
equivalent for fees which my executor, hereunto named will make.
And, lastly, I so hereby constitute and appoint my son George
Hazel to be my Executor of this my last will and testament, revoking and
annulling all former wills ratifying and confirming this and no other to be
my last will and testament. It being my wish and will that my slave
Josep Clark shall be free and thereby declare him to be free from
all service whatsoever from and after the age of twenty eight. In
witness whereof I have hereunto set my hand and seal this second
day of August in the year of our lord, Eighteen hundred and thirty
one. signed by Benjamin Hazel
Signed, sealed, published and declared by witnesses named by
Benjamin Hazel to be his last will and testament in the presence of us, who
at his request and in his presence have hereunto subscribed
our names as witnesses to the same.
