William Ross died in 1796 leaving a Widow who is since dec. and eight children to wit Charles Edward since dec leaving issue two children namely Nancy & Mitchell Ross, Gibson, the petitioner. Nancy who intermarried with John Truitt since dec. leaving issue children names unknown. Nathaniel, Caleb, William and Daniel Ross.
And now to wit this 9 March 1814 – To this Court comes Gibson Ross, assignee of Charles Ross, Eldest son of William Ross, late of the Northwest Fork Hundred who died in testate, leaving issue either children, to wit, Charles Edward, since dec leaving issue Children Nancy & Mitchell, Gibson, the petitioner, Nancy who intermarried with John Truitt since dec, leaving issue children name unknown, Nathaniel, Caleb, William & Daniel Ross, his heirs at law. That in consequence of proper proceeding had in the Orphans’ Court, the in testate Lands of the said William Ross that was laid off the widow of her dower was, on the fourth day of March One thousand eight hundred & fourteen valued by the freeholders appointed by this court at the sum of two dollars and fifty cents per acre there being two hundred and seventy nine acres. The appraised value of that part of the lands of the said William Toss that was laid off to the widow as her dower amounting to the sum of six!
hundred & ninety seven dollars and fifty cents and the said Gibson Ross assignee of Charles Ross by his petition, prays that the said lands and tenements may be ordered to him the said Gibson Ross his heirs and assigns, he the said Gibson securing the payment of the respective shares of the valuation money, of the said one third of the in testate lands of said William Ross, deceased.
Thereupon it is ordered by the court that said Gibson Ross assignee of said Charles Ross do have and hold to him the said Gibson Ross his heirs and assigns forever all those part of the lands and tenements late of him the said William Ross dec that was laid off to the Widow as her dower, and that he the said Gibson Ross do give good security to pay the other heirs of the said William Ross deceased, their respective shares of Six hundred & Ninety seven dollars and fifty cents being the valuation of the said lands and tenements.
Whereupon that said Gibson Ross of Northwest Fork Hundred Yeoman and William Ross of Northwest Fork Hundred Yeoman jointly and severally acknowledge themselves to owe to the State of Delaware, the sum of One Thousand three hundred and ninety five dollars lawful money of the United States of America, to be levied of their Good and Chattels, Lands and Tenements respectively, upon condition, that if he the said Gibson Ross his heirs, executors or administrators, do and shall we and truly pay or cause to be paid, to the other heirs of the said William Ross deceased, or to their legal representatives, there respective shares of Six Hundred and Ninety Seven dollars and fifty cents the appraised value of the one third the lands and tenements of the said William Ross deceased, with interest thereon from the tenth day of August in the year of Eighteen Hundred and Eleven on or before the first day of October next then this Recognizance to be void, else to be and remain in fill force a!
