Harris CountyI John Patillo of Said county and State being of advanced age
and knowing that I must shortly depart this life, deem it right and proper both
as respects my family and myself that I should make a disposition of the
property with which a kind providence has blessed me, do therefore make this
last will and testament hereby revoking all others made by me-----------
Item 1st I desire and direct that all my past debts be paid
without delay by my executors hereinafter appointed
Item 2ndI give bequeath and devise to my beloved wife Polly
Patillo, lot of land number three hundred and forty eight (348) in the (20th)
district originally Muscogee now Harris County also south half of lot number
one hundred and seventy (170) formally Troup now Harris County also north half
of lot number (325) three hundred and twenty five also (20th) twentieth
district originally Muscogee now Harris County containing four hundred acres
more or less to all the rights, numbers and appurtenances to said land in any
wise belonging, also a Negro man named Joshua about 30 years of age yellow
complexion, one Negro woman named Eliza and her two children Coleman and Jane
with her future increase also a Negro woman Cinda aged about (39) and her child
Ned also, her future increase, also a young Negro man name Denny (sp?) about 18
years old of light complexion also two beds and furniture, two choice milch
cows, two choice horses or mules, one yoke of oxens and cash, two sets plows
tools to harness two choice sows and pigs with one years provisions for the
family and stock from the time the division takes place, also my carriage and
harness with a sufficiency of the household and kitchen furniture for her use
to hold and possess the above described property during her widowhood and in
the event of marriage the distribution of my entire estate to take place and
she Polly Patillo to have a child’s part.
Item 3rdI have given to my son Nathan W. Patillo land and other
property to the amount of twenty one hundred and forty three dollars, I have
given to my daughter Elisabethen Poer land and two young Negroes Sam and Candis
valued at fifteen hundred and thirty five dollars, I have given to my son James
Patillo land and other property valued at twenty nine hundred and thirty seven
dollars. I have given to my daughter Nancy Rush money land and other property
to the amount seventeen hundred and ninety dollars, I have given to my daughter
Mary A Ridenhour and her children one Negro woman and her son Arthur with her
future increase for the use of her and her children free from the debts
contracts &c of her present or future husband, also four hundred and ninety
dollars all valued at eleven hundred and ninety dollars, & appointed John
Patillo junior trustee to hold the same for the use of her and her children, I
have also given to my to my son John Patillo a horse, bridle and saddle valued
at one hundred & twenty dollars also given him one thousand dollars in money
also graduate him at Oxford Colledge and charge him one thousand dollars for
it, making in all twenty one hundred and twenty dollars, I have given to my
daughter Martha Turner one Negro girl named Patsy thirteen years old money and
land amounting to eighteen hundred dollars. I have given my son Chas T.
Patillo one Negro man named Henry, horse saddle & bridle land and his medical
diploma all valued at thirty six hundred and five dollars, I have given to my
daughter Sarah Hightower a Negro woman land and other property to the amount of
Eighteen Hundred & fifty dollars, I give to my son William P. Patillo his
diploma at Oxford Colledge one horse and seven hundred dollars in money valued
at nineteen hundred and twenty five dollars, I have given to Reuben S. Patillo
one horse and buggy valued at Three hundred dollars all of which Several
amounts herein named will be deducted from their legacys when the entire
distribution of my estate shall take place.
Item 4th I further divise unto James Patillo & my son in laws Jackson
Rush and D. M. Poer a certain body of land lying on the Chattahoochee River lot
number sixty four (64) in the twentieth district-part of lot number one hundred
and five (105) part of fraction number three hundred and seventy one (371)
fractions three hundred and seventy (370) and three hundred and seventy two
(372) all lying south of Mountain Creek containing (600) six hundred acres more
or less & this is to be the entire and all the interest of Jackson Rush, D.M.
Poer and my son James Patillo in my estate to be equally divided.
Item 5th It is my will that after my death my entire estate not
heretofore disposed of be equally divided or sold and an equal distribution of
the funds arising there from—between my children not heretofore named as not
having received there full legacy taking into consideration the amounts that
each have heretofore received—
Item 6th It is my will & desire that that portion of my estate going to
Mary A. Ridenhour at the distribution of my estate, will be held by her trustee
free from any debt contract &c of her present or future husband, her former
trustee having resigned and left the state, I hereby make, appoint and
constitute Reuben S. Patillo her lawful trustee to take charge of the remaining
interest of said Mary A. Ridenhour in my estate to manage and use the same for
the use and benefit of said Mary A. Ridenhour & her children. I hereby appoint
my sons Nathan W. Patillo & Reuben S. Patillo my executors—

the presence of us the subscribers who has subscribed our names hereunto in the
presence of said testator at his official instance and request and of each other
July 2, 1859

after examining the signature of the testator to said will to wit – John
Patillo the same is the proper signature and hand writing of the said John
Patillo dec’d.

in and for said county Reuben Patillo constituted & appointed in a paper
writing purporting to be the last will and testament of John Patillo late of
said county dec. & executor of said deed and produced said paper writing for
probate and also appeared R.G. Hood, James H. Cowserh(sp?), R.S. Patillo—who
being duly sworn depose and say that after examining signatures of the
attesting witnesses thereto to wit: C.H. Davis, W.W. Hunt and P.S. Weeks, each
and all of said witnesses being dead said, signatures are in the handwriting of
the aforesaid witnesses to the best of their knowledge and belief.

Additional Comments:
This is to the best of my reading/spelling ability. I punctuated as I found it
but did not put in all the capital. I would be interested in hearing from
anyone who is a descendant of John and Polly Patillo, originally from Greene
County, then from Harris County. Both are buried at New Hope Cemetery in
Harris County.
