"Georgia, Elbert County) In the name of God Amen I John Oliver of
the town of Petersburg in said county and State, being of precarious
health, but of sound mind, memory and judgment and taking into view
the certainty of death, do now after a full investigation of all the
worldly goods whereof God in his bounty, hath made me steward, and a
reconsideration of what seemeth to me right, make ordain publish and
declare this to be my last Will and Testament, hereby revoking all
other Will I may heretofore have made. It is my will and desire that
my body be decently committed to the grave whenever it shall please
God, at the intercession of my most blessed Redemer to vouchsafe to
pardon my sins and take me to himself. Item - It is my will and desire
that all my just debts be paid This I wish to be done with the money
which may be due to me at my death. Item - I give and bequeath unto my beloved
wife Susanna Oliver the tract of land called Sharps place
lying in this county on Broad River and extending the said tract down
the said River as far as the first branch below the said plantation
thence up the said branch or bottom to where the said bottom come to
the road leading up the country, further give to my said wife the
house and one half acre lott in the town of Petersburg now rented to
Chas. Hudson I also give and bequeath unto my beloved wife Susanna the
following negroes, to wit -Sender, Lawsen, African Joe, Emanuel, Jane
his wife, Ben, William, Thomas, Elizabeth her children, Blue Joe,
Betty his wife, Robin, Elias, Matilda her children Harry, Catharine,
Eliza and g__naw, with their future increase - Also I give to my
beloved wife my carriage and gear and the pair of horses which ___
be usually used therein at my death. I also give and bequeath unto my beloved
wife the twenty five shares of hranch stock which I own in
the bank of Augusta. Item I give and bequeath to my daughter Prudence
T. Watkins, wife of Robt. H. Watkins, the following negores, to wit,
Adam, Mina his wife, Hunter, Mary, Hagar her children, Rachel, Aggy,
her daughter, Shphea, Chan__, Jefferson, Young, Rachel, Mria children
of Aggy, sic, Phillis Edg Becky one eyed Jacob Fanny Mary Larkin and
Anthony and their future increase. Item - I give and bequeath to my
daughter Polly X. Bibb wife of Jno. D. Bibb, the following negroes
(to wit) Gib, Blacksmith Bill, Lucy, his wife, William Arey Dan
dredge, children of Lucy, Mark, Cloe, his wife, Jack _herson, Cumbo,
Dan, Judy, his wife, Caroline, Juley, young Dan, Dolly Dandredge,
children of Judy and Sam and their future increase. Item I give and
bequeath to my son John Oliver all the several tracts and parcels of
land which I own in this State except the land already given to my
beloved wife including the lotts I now own or may own at the time of
my death in the town of Petersburg as also the small parcel of land
called the ferry landing on the Carolina side of Savannah River
together with all and singular the improvements thereon including
the houses and ferry boats, I further give to my son John the
following negroes (to wit) Ceasar, Jacob, Nancy, his wife, Carpenter
John, Clary, Phelisia, Dick, Amy, Seller, Creacy, Porter, Anna, his
wife, Sally, Failly, Mary children of Anna, blacksmith John, Mariah,
his wife, Simeon her child Aaron, George, Will, Lucy, his wife,
Melton Washington Hittavina, Smiths, Lucy recalled - Erasmus, Mason
John Robbin, little John, Dick, Toney and Randal and their future
increase. I further give and bequeath unto my son John Oliver the
twenty five shares of Bank stock which I have subscribed for in the
Bank of the State of Georgia. Item Give and bequeath to my good
friend and son in law Daniel Bird the picture and frame over my
chimny peace (The Redemer) and two dollars to be paid to my said
former son in law by my Executors. Item It is my will and desire
that my Executors and Executrix do keep together all the property
herein devised to my beloved wife Susanna and my son John, on the
several tracts or parcels of land I have bequeathed to them, untill
my said son shall become of age or marry, or untill my said wife
shall wish a seperation or shall marry, and the proceeds thereof,
together with the profits from my ferry, after defraying all the
expenses of croping and the ferry, to be equally divided between my
said wife and son. It is further my desire that whenever a seperation
of the said property shall take place that my said wife shall have
her choice of six of my cows and calvs, four sows and pigs, a waggon
and team of mules four in number, with gees to be taken out of such
stock as may then be on the plantation as also twelve vollums of her
choice of the books in my library two trunks, two beds and furniture
and five hundred dollars to be taken out of the product of croping
before an equal division of the proceeds of the then pending crop,
to be laid out according to her own choice in furniture. Item All
the debts which may be due to me at the time of my decease except
for cotton sold and what may be necessary to pay my just debts. I
give to be equally divided between my daughters Prudence T. Watkins
and Polly X. Bibb. Item I moreover give to my son Joh Oliver after
his property herein bequeathed to him shall be seperated from that
of my wife - all the rest and residue of my furniture, my gold
watch, clock and every other thing property of whatsoever decrip
or denomination, and cash on hand and the cash at the time of my
death. Item - It is my desire that should my beloved wife Susanna
die befoe her marriage, that all the property bank stock and increase
thereof except the property given to her by her father shall be
equally divided between my three children, to wit, Prudence, Polly
and John. Item Finally it is my will and desire that in case either
of my daughters (to wit) Prudence T. Watkins, Polly X Bibb die not
leaving legal issue or my son John Oliver die not having legal issue
nor attained the age of twenty one years, all the property herein
bequeathed shall be equal divided between the survivors of them and
their heirs and assigns forever. Reposing special confidence in the
integrity and uprightness of my wife sons in law, I do hereby appoint
my wife Susanna Oliver Executrix and my son in law Robt. H. Watkins
and Jno. D. Bibb and my brother James Oliver Executors of this my
last will and testament in testamony Whereof I have hereto set my
hand and seal this tenth day of December 1816. Signed published and

"Georgia, Elbert County) Court of Ordinary January term 1817
personally appeared in open court Samuel Watkins and William N.
Richardson and being duly sworn say that they were subscribing
witnesses to this annexed will of John Oliver decd. that they saw
him sign seal and deliver the same as his last Will and testament
that he was of a perfect and disposing mind at the time he executed
the same and that these deponants signed the same as witnesses
together with John Watkins the other subscribing witness in the
presence of each other and in the presence of the said deceased
and at his request. Sworn to in open court this 6th day of January
1817.
