This Indenture, made this seventeenth day of May eighteen hundred and thirty
one between Frederick Barefield of the County of Washington and state
aforesaid of the one part, and Augustin Slaughter and Charles Labuzan of the
County of Richmond and state aforesaid of the other part Witnesseth, That the
said Frederick Barefield for and in consideration of the sum of five dollars,
and for the securing of the said Augustin Slaughter & Charles Labuzan in the
payment of a certain sum of money, to wit, the sum of three thousand seven
hundred and seventy nine dollars and thirty eight cents, which amount was due
by Frederick and David Barefield late merchants and copartners trading under
the name and style of F. & D. Barefield on the nineth day day of this instant
with interest till paid, hath bargained sold and conveyed and by these
presents doth grant, bargain, sell and convey unto the said Augustin Slaughter
and Charles Labuzan the following lot of land, situate, lying & being in the
county of Hancock and state aforesaid lying near Mount Zion Academy, beginning
at a stake near the academy lot, then running four degrees N three chains and
thirty one links to a stake, thence S 56 degrees W. three chains & thirty
links to a stake; thence S 34 degrees E three chains and thirty links to a
stake; thence to the beginning corner, containing one acre, being the house
and lot which John E. Smith purchased of John G. Gilbert, adjoining Gilbert
and the academy lot, and also the following tract of land, situate, lying and
being in said County of Hancock butting and bounding as follows, beginning at
a water oak near the branch of what was formerly Lucases corner; thence
running S75E 29 chains & 50 links to a red oak; thence N79E 9 chains to a red
oak, thence West 73 E 18 chains to pine X; thence S18E 26 chains 50 links to
hickory S42W 11 chains to a Walnut sprout; then down the meanderings of the
Shoulderbone creek to the junction of what was called Lucas branch; thence up
said branch to the beginning, containing two hundred and eight acres be it the
same more or less. To have and to hold the said described lot and and tract
of land, together with all and singular the rights, members and appurtenances
thereunto belonging, unto them the said Augustin Slaughter and Charles
Labuzan, their heirs and assigns, to them and their own proper use benefit and
behoof forever upon the condition however, that if the said Frederick or David
Barefield shall satisfy and pay the said Augustin Slaughter & Charles Labuzan
said sum of three thousand seven hundred and seventy nine dollars and thirty
eight cents, with legal interest thereon, and all costs which may be incurred,
in relation to said debt, then this indenture to cease and become of no
effect, otherwise to be and remain in full force and virtue.
In testimony whereof the said Frederick Barefield hath hereunto set his hand
and affixed his seal the day and date first above written, the
word "Shoulderbone" interlined before signed.
