I have no knowledge of this, but it strikes me that if people start
contemplating digging up old ancestors to get DNA samples it will be 1)
cost prohibitive and 2) so riddled with governmental regulations and rules
prohibiting this sort of thing you probably have little chance. If the
regulations are not in place, they will be as soon as people start trying
to do this. Even police departments have to get court orders to exhume
bodies for homicide investigations.

I should think your best bet would be to do some more research and find
either other known descendants of this suspected ancestor or of his
siblings or father, if it is possible. If you want to carry on the
research in this line you will need to do this eventually anyhow.
