This James AGG changed his name!
"James Agg-Gardner by his then name of James Agg (he having afterwards

OK.... here's what I know:

I used to live in a cottage (one of 13) at Charlton Kings, and when I
bought it back in 1979 I obtained the old deeds, and because I had to
register the title, I was able to keep the old deeds. Only a week ago I
parted with them... to the Gloucester Records Office. I thought that
someday someone would come looking for James Agg-Gardner or someone else
mentioned in the documents, and therefore I felt that it would be better
to have them accessible to all... instead of in my filing cabinet ;-)

And within days you come along!! ;-)

The deeds show the line of ownership of the cottages back to the early
1800's, but also give some quite interesting information about the AGG &
GARDNER families and the "merger". The document makes quite difficult
reading following the logic ... typical solicitor's stuff without
punctuation ;-) But for your information I transcribed it and kept a
copy on computer...

James Tynte Agg-Gardner M.P. to Joseph Price, 2nd May 1876 for the sum
of four hundred pounds.

of hereditaments at Charlton Kings

J. T. Agg-Gardner Esq. M.P. to Mr Joseph Price

Dated 2nd May 1876

This Indenture made the second day of May One thousand eight hundred and
seventy six Between James Tynte Agg-Gardner of Cheltenham in the county
of Gloucester Esquire M.P. of the one part and Joseph Price of Charlton
Kings in the said county Wheelwright of the other part

Whereas at a Court of the Lord of the Manor of Cheltenham aforesaid
holden on or about the twenty fourth day of February One thousand eight
hundred and sixty nine the same James Tynte Agg-Gardner who is the
eldest Son and heir according to the custom of the said Manor of James
Agg-Gardner heretofore of Cheltenham aforesaid Esquire deceased who died
intestate on the Twelfth day of March One thousand eight hundred and
fifty eight having survived Mary Gardner heretofore of Cheltenham
aforesaid Widow of John Gardner heretofore of the same place banker and
Common Brewer deceased And which Said Mary Gardner and James Agg-
Gardner by his then name of James Agg (he having afterwards assumed the
name of Gardner after and in addition to his names of James Agg) were
the Devisees in trust under the Will of the said John Gardner bearing
date the Thirtieth day of May One thousand eight hundred and thirty
three and a Codicil thereto bearing date the Eleventh day of April One
thousand eight hundred and thirty five the said Will and Codicil having
been duly proved by the said Mary Gardner and James Agg-Gardner in the
Prerogative Court of Canterbury on the first day of July One thousand
eight hundred and thirty six the said James Tynte Agg-Gardner being also
under and by virtue of the said Will and Codicil of the said John
Gardner and of a certain Indenture of Settlement bearing date the
Twelfth day of October One thousand eight hundred and forty four and
expressed to be made between the said James Agg-Gardner of the first
part Eulalie Northey Spinster therein further described of the second
part and William Richard Hopkins Northey Esquire of the third part
equitable tenant in the tail of certain hereditaments of which the
hereditaments hereinafter described form part of the equitable estate
tail in which was barred by a certain indenture bearing date the
Fifteenth day of October One thousand eight hundred and sixty eight and
made between the said James Tynte Agg-Gardner of the one part and
Rowland James Ticehurst Gentleman of the other part and entered in the
Court Rolls of the said Manor was admitted tenant to the said
hereditaments To be had and holden unto the said James Tynte Agg-Gardner
to his heirs and assigns for ever according to the customs of the said
Manor

And whereas the said James Tynte Agg-Gardner hath agreed with the said
Joseph Price for the sale to him of the hereditaments hereinafter
described and the inheritance thereof in fee simple according to the
custom of the said Manor of Cheltenham free from incumbrances but
subject to the rents and services for the same due and of right
accustomed for the sum of four hundred pounds

And whereas in pursuance of the said Contract at a Court of the Lord of
the said Manor of Cheltenham holden on the day of the date but before
the execution of these presents the said James Tynte Agg-Gardner in
consideration of the payment to him by the said Joseph Price of the sum
of Four hundred pounds amount of the purchase money did surrender the
hereditaments hereinafter described To the use of the said Joseph Price
his heirs and assigns for ever according to the custom of the said Manor
as settled by Act of Parliament and he was admitted tenant thereto

Now this indenture witnesseth that in consideration of the sum of Four
hundred pounds before the making of the lastly hereinbefore recited
Surrender to the said James Tynte Agg-Gardner paid by the said Joseph
Price the receipt whereof he the said James Tynte Agg-Gardner doth
hereby acknowledge and doth therefore release and discharge the said
Joseph Price his heirs executors administrators and assigns he the said
James Tynte Agg-Gardner doth hereby release ratify and confirm unto the
said Joseph Price and his heirs All that cottage formerly in the
occupation of [the said] Thomas Hamlett deceased adjoining to a public
House called the Royal Hotel And also All those twelve other cottages
now or late in the respective occupations of ..... Protheroe ......
Short, William Bond, ..... Witts, ....... Bowyer, Frederick Portans,
William Young, ....... Portlock [first names not shown] and others
adjoining each other and situate near to the said messuage or public
House which said thirteen cottages and the public house were erected on
a piece of land containing three quarters of an acre or thereabouts [in
Charlton Kings aforesaid] Together with all hedges [ditches] mounds
fences trees ways wells pumps waters watercourses lights and all other
rights easements members and appurtenances to the said land cottages and
hereditaments belonging or in anywise appertaining or therewith usually
held occupied or enjoyed And all the estate right title interest benefit
claim and demand whatsoever of him the said James Tynte Agg-Gardner
therein or thereto To hold the said hereditaments unto the said Joseph
Price his heirs and assigns for ever according to the custom of the said
Manor as settled by Act of Parliament And the said James Tynte Agg-
Gardner doth hereby for himself his heirs executors and administrators
covenant with the said Joseph Price his heirs and assigns that
notwithstanding any act or thing by the said James Tynte Agg-Gardner or
any of his ancestors done or suffered to the contrary He the said James
Tynte Agg-Gardner had at the time of making the surrender lastly
hereinbefore recited power to surrender the hereditaments hereinbefore
expressed to have been this day surrendered with their appurtenances
unto the said Joseph Price his heirs and assigns in manner aforesaid
And that it shall be lawful for the said Joseph Price his heirs and
assigns at all times hereafter to enter upon possess and enjoy the same
hereditaments with their appurtenances and receive the rents and profits
thereof without any interruption or disturbance by the said James Tynte
Agg-Gardner or any person claiming or to claim through under or in trust
for him or any of his ancestors And that free from or by the said James
Tynte Agg-Gardner his heirs executors or administrators effectually
indemnified against all estates rights titles charges and incumbrances
created or occasioned by the said James Tynte Agg-Gardner or his
ancestors and in particular against [the payment of] a Sum of Seven
thousand four hundred pounds to Arthur Agg-Gardner the Brother of the
said James Tynte Agg-Gardner and which has been specially charged on
other portions of the Estate of the said John Gardner deceased and to
the payment of a jointure rent charge of One thousand pounds a year to
Mrs Eulalie Emily Agg-Gardner the Mother of the said James Tynte Agg-
Gardner during her life and which said sums are payable under or by
virtue of the Will of the said John Gardner and the Indenture of
Settlement of the Twelfth day of October One thousand eight hundred and
forty four hereinbefore referred to and against any loss damage costs or
expenses incidental to or arising from the nonpayment of the same or any
incumbrances created or occasioned by any other person claiming or to
claim through under or in trust for him the said James Tynte Agg-Gardner
or his ancestors

And further that he the said James Tynte Agg-Gardner and his heirs and
every person claiming or who shall claim any estate right or interest at
law or in equity in or to the hereditaments hereinbefore expressed to be
hereby surrendered or any of them or any part thereof through under or
in trust for the said James Tynte Agg-Gardner or his ancestors will and
shall at all times hereafter upon the request and at the expense of the
said Joseph Price his heirs or assigns do and execute or procure to be
done and executed every such surrender act and deed for further better
and more satisfactorily surrendering and assuring the hereditaments
hereinbefore expressed to be hereby surrendered and released and their
appurtenances unto and the use of the said Joseph Price his heirs and
assigns or otherwise as by the said Joseph Price shall be reasonably
required In Witness whereof the said parties to these presents have
hereunto set their hands and seals the day and year first above written

It never ceases to surprise me how innacurate or incomplete the IGI is
when it comes to transcripts when compared with the church registers.

e.g.

MAR M Neep John & Mary SMEDLEY 11 5 1776 (IGI)

MAR F Neep Hannah & Garvis GIBSON 20 1 1784 (IGI)

There are *lots* more examples... that last one I could have missed

Moral:

surname in GLS., primarily 1800-1900, and would appreciate any

necessarily in that era either. There may be a connection with the
parish? of Uley ( I think that this is the correct spelling )and any

Hi Rod & list members

It seems all the Heavens have died & gone to Heaven. I'm after info on Henry
HEAVEN m 17 Aug 1872 in Stroud, GLS Julia Annn MARMONT. He emmigrated to NZ
in 1874.

I suspect his father was Henry Heaven, mother Lucy Hoskins(?) and he was
born on the 28th Nov 1838 at 61 Stone(?) St, Cheltenham. His 2nd child (1st
daughter) was Florence Lucy.

I finally got one of those "round tuits" and made the effort to enter a

Hi Everyone: I am researching William HOLBROW b. May 1795 who appeared on
1841 census for Avening in Stroud, wife Sarah THOMAS; children: Daniel,
Maria, Julet, Sarah, Elizabeth, Lewis, William. William is the son of
William and Mary HOLBROW of Wanswell Court in Berkeley. Interested in
information on Sarah Thomas as well as William and children. Any information
will be greatly appreciated.

Hi Roger, are you grovelling comfortably? Then I'll begin . . .

Unless you already have a copy of the booklet "Who's Who in Gloucester
1910", I might be able to help. In that publication, of which I have a
dog-eared copy, the following Brutons are listed, each with a brief biog
and address, and most with a one-inch black/white photograph:

Basil Vassar BRUTON
George Norman BRUTON
Henry Tew BRUTON
Henry William BRUTON
James BRUTON (a long biog)
James BRUTON, Mrs (nee Butt)

There is also a brief entry for Harley BUTT (" . . . a partner in the firm
of J.M. Butt & Co. . . . ) in case it's relevant. I have looked at your web
site, and can also offer you a brief entry for the Rev. Samuel Richmond
ROBERTSON, who is in your list. Additionally, there is a full page Bruton
Knowles advertisement.

My grandfather, John Forrester Raikes BEVAN, was a director of the Priday
Metford flour milling company, close to the Albert Flour Mills, of which
James BRUTON was chairman, and I'm sure I heard the Brutons spoken of in my
grandfather's house. Next time I telephone my extraordinary Aunt Lilian,
who was 95 this year and still remembers every detail of her early life in
Edwardian Gloucester, I'll ask her.

I'd be happy to photograph the relevant pages and send them to you. I can
also scan the photographs and send them to you as email attachments, if
that would suit you.
