COUNCILLORS have effectively blocked a former welders bid to get £70,000
from people living on a small estate.
They nodded through the re-adoption of a small section of road which
controls the entrance to Townhead Park in Collin.
It is believed that should scupper a bid by the so called Raider of the
Lost Titles to get cash from the families who live there.
For the past two months their lives have been turned upside down following
demands from solicitors acting on behalf of Brian Hamilton, the man who
bought the title of Baron of Rockhall.
He used the ancient office to claim ownership of the road which was
stopped up when the A75 bypass was built many years ago.
Mr Hamilton wanted £5,000 from each of the 14 households plus his legal
costs.
Solicitors acting for the families, Dumfries MSP Dr Elaine Murray and
newly elected Dumfriesshire, Clydesdale and Tweeddale MP David Mundell and
local councillor Ivor Hyslop, have all piled pressure on the authority to
take action.
Counsels advice was sought and yesterday the planning and environmental
services committee nodded through the re-adoption recommendation.
The council has the backing of the Scottish Executive to use its statutory
right to make the move.
Mr Hamilton may decide to go for a Judicial Review but the council is
confident it has acted correctly and would not lose.
Jim Dalziel, Tynwald community councillor and one of the residents
affected, welcomed the news.
The last couple of months have been a nightmare for us all, he said.
Ill sleep better tonight as will my elderly neighbour.
Everyone I have spoken to so far has is over the moon.
The weight has been shifted from us.
Now we will have to wait and see what happens.
