THE FREMONT COUNTY SUN. April 2, 1909.--The case of John Eichorn - vs - the City Telephone Company, a suit to recover from the Company the value of a horse which while being driven through the streets of Imogene about the 4th of February last, became entangled in a broken wire which was borken by the heavy wind on Jan. 25th ult., and by its struggle to get free, so injured itself that it fell dead. It was claimed by plaintiff that Mr. Tilman was negligent about repairing his wires and was liable for the value of the horse. Defendant denied responsibility on account of the accident. The case was tried to a jury and much testimony was offered on the part of plaintiff but he failed to satisfy the jury who soon returned with a sealed verdict, and upon the opening of court Wednesday the verdict was opened and found to be in favor of Mr.Tilman.
