We discussed the privacy issue on the Franklin County List. The
consensus was that we should follow the "72 year privacy act" set forth
by the Federal Government. Census records are not released for 72 years
after enumeration.
The Franklin County Court House follows the same principal for their
court records. You can request a record that was made less than 72
years
ago (and the clerks will do the search)...but a private individual can
not randomly search thru these records.
There is a definite difference between court records and published
information...as in "Legacy of Kin" which is compiled from newspapers.
Newspaper published information is immediately public information.
The Webb Family of Franklin County Project has amassed 15,000
descendants. We were contemplating putting the entire database on CD
for
distribution to descendants....but have decided that because the
database contains vital information that is less than 72 years old,
this
would be a dis-service to those people. It only takes one
indiscriminate person to place all 15,000 names on a web site.
