Last Will and Testament
Of
Thomas Lindley
(3/26/1801 – 5/7/1880)

I Thomas Lindley of the County of Parke and State of Indiana of the age of seventy seven (77) years, being of sound mind and memory, do make constitute and appoint, this to be my last will and Testament in manner and form as follows.
1st That all my just debts and charges be paid.
2nd That I will and bequeath to my wife Mary Lindley of my personal property, two beds and the bedding therefore, and that she have the first choice cow and calf, and that she have (if it be her choice) the dwelling house and out buildings now occupied by me. So long as she remains my widow, also that she have Three hundred dollars ($300) in cash and that she have bureau, Table and cupboard & clock.
3rd That I will and bequeath to my granddaughter Martha Ann Lindley, of my personal property and bed and necessary bedding therefore and also one pair of bedsteads, that she have of my cattle one good average cow & calf.
4th That the remainder of my personal property (not mentioned in 2nd & 3rd articles of this will) be sold at public auction, and the proceeds thereof together with money and notes (if any) be divided between my children viz. that my son William Lindley and my daughter Eunice Sivage receive each one fifth. That Thomas E., Mary Ellen, Martha Emma, Elmira E., James Albert Maris and Cora A Maris heirs of my daughter Eleanor receive one fifth. That Martha, Harriet E, Lavina and Mary Anna Lindley, heirs of my son Nathan Lindley receive one fifth. And that Joseph T and Mary Jane Kates heirs of my daughter Catherine receive one fifth.
5th That I will and bequeath to my son William Lindley & heirs (of his body) all of my Real Estate I now own, viz. East half of the South West Quarter and west half of South East Quarter Section eleven (11) Town Seventeen (17) range eight (8) West. Except two (2 ½) acres and one half in South West corner of East half of South West Quarter on which the meeting and school houses are now located. Said Real Estate containing one hundred and fifty seven and one half (157 ½) acres more or less upon the following conditions viz. That my wife Mary Lindley have her maintenance of the said farm, so long as she remains my widow, and upon my son William Lindley, compliance with said conditions, the said premises as aforesaid mentioned to pass full simple to my son William Lindley’s heirs forever.
6th That I hereby appoint Jonathan Hadley and Malow Lindley Executors of this my last will and testament, hereby authorizing and empowering them to compromise, adjust, release and discharge in such manner as they may deem proper the claims due me, also to settle all my just debts and charges, as set forth in article 1st hereby revoking all wills heretofore by me made Dated 2nd month, 5th day 1879.

The above indenture in writing was acknowledge by Thomas Lindley, consisting of one sheet, as his last will and testament in our presence, and signed by us in his presence and in the presence of each other.
