The Court Grind.
The STUART-EVANS case was given to the jury about four o'clock Friday and it was near midnight when they finally brought in their verdict. Several questions of fact were submitted to them and all of these questions they answered in favor of the plaintiff. The defendant at once made a motion to set aside the verdict and the motion with the further adjudication of the case, will be heard by Judge MYERS in chambers in Valley Falls on the 25th of June.
Saturday morning the case of STRAWN vs WEATHERFORD as sheriff, was called, a jury sworn and the taking of testimony proceeded with until about six o'clock when the court adjourned until Monday morning at ten o'clock, at which time the case was proceeded with. Under instructions from the Judge the jury found for the plaintiff. Motion for new trial over-ruled, and defendants allowed ninety-days to make case for the appelate court. As the cases TOSH vs WEATHERFORD and FERRELL vs WEATHERFORD involved some of the same questions, thesse cases were continued until a decision of the higher court should be rendered.
The case of WHITMAN vs HILLYER was continued by consent.
In the case of Terry CRITCHFIELD brings suit on a promissory note for $100 given by Robt. SMITH and others to take up a note forged by a certain McCARTHY some years ago a jury was waived and the court decided in favor of the defendants that the note was void from want of consideration, and taxed the costs to the plaintiff. Motion for new trial over-ruled.
