Subject: [KYBATH] Bath Countians Migration to Middletown OH
Date: Wed, 15 Sep 1999 07:11:22 EDT
Hi All,
This a somewhat subdued Vivian this morning. I went (as I said I would) to
the Library and copied the 1891 Middletown City Directory. Years ago, it
never occured to me that I might be doing something wrong doing this for my
own use.
Seems, that in 1991 A lady wanted to re-copy the Directory due to its
deterriorated condition and since it was their Centennial/Bicentennial (can't
remember which) she wanted to do books to sell . She got a copyright on the
book.(A pending one)
I phoned her last night to see what the status of the Copyright was and she
wants me to hold of doing anything with the Directory until she can determine
the status of the Copy Right.
Seems they only gave her a temporary one (probably just for the occasion of
the centennial ) She told me she had about 3 books left if I wished to buy
one. I advised her I had already copied the book and didn't have need of
another one.
We discussed what effect posting the Directory would have on her selling any
more books.....seems she is going to re-do them for the Millenium with the
logo etc. and again they will be for sale.
I told her last night...I will not do anything with my copy until I get a
letter from you telling me I can-cannot post the Directory.
She promised me she will get right on it ...checking out the Status of her
copyright. If in fact, it has returned to public Domain we will post
it.....if not, Guess we will have to buy one.:-)
I tried my best to make her realize that I copied this book of 1891 without
any reservations since I had been told that anything before 1900 was public
domain. It was after the fact and as I was starting to leave that I stopped
at the Desk to see what had happened to the 1914 thru 1939 Directories that I
learned about the re-copy and the copyright of the 1891 Directory.
This has generated so much positive input that I think it is a shame we are
in this dilema and I do apologise to everyone.......I was just too
enthusiastic I guess.
I promise to keep everyone posted tho.....meanwhile, keep exchanging the
information. Jim, FYI.... there were no Sorrell's in Middletown City Proper
in 1891.
Blessings!
Vivian
