THIS DEE OF CONVEYANCES, madeand entered into this the 28th day of
December, 1923, between Georgie Hawn, a widow, Goble Hawn and his wife
Bettie Hawn, M Lewis Hawn, Maymie Hawn and Maggie Hawn parties of the first
part, and Nannie Hawn party of the second part. Witnesseth.
THAT WHEREAS there was heretofore an action in the Knox County Court
styled Alice Golden,, plintiff Vs: James Hawn et al defendants seeking the
partition of a tract ofland owned by Jacob Hawn at the time of his death, and;
WHEREAS, the parties to the action, to-wit; Alice Golden and her husband
I. H. Golden, James Hawn and his wife Georgia Hawn, Effie Fuller and her
husband Thomas Fuller, and Nan nie Hawn were the childer and heirs-a t-law
of the said Jacob Hawn, deceased, to which the lands of the said Jacob Hawn
deceased at his death, and.
WHEREAS, during the pendancy of said action a written agreement was
entered itto between the parties to said action, who, ashertofrom stated,
were the children of heirs of Jacob Hawn, deceased by the terms of which it
was specifially set forth that the party of the second part in this deed,
Nannie Hawn, should take as her interest in the lands of the said Jacob
Hawn, deceased, the particular land described in this deed, and said
writing is ofrecord in the Clerk office in the Knox County Court, in Order
Book O, at page 88, and is dated the ____ day of April, 1922 and.
WHEREAS in pursiance of the aforesaid written agreement the childern and
heirs-at-law of the said Jacob Hawn, deceased, undertook to carry out the
provision contained in said writing, by the terms of which a particular
described boundary of land, wasby deed conveyed to the said Alice Golden by
the others children and their hiers of the said Jacob Hawn, deceased, as
her interest in the lands sought to the divided, and a particular parcel of
land was conveyed by deed to the said Effie Fuller by the other children
and heirs of Jacob Hawn, deceased as her interest in the lands sought to be
divided, and.
WHE#AS, there was another particular parcel ofland conveyed by a deed to
the said James Hawn, by the other children and heirs of the same Jacob Hawn
as his interest in the land sought to be divided and as particular parcel
land which was allotted to the said Nannie Hawn by the terms of the writing
aforesaid, was attempted to be conveyed to her by ded by the other heirs of
Jacob Hawn, deceased as her interest in the lands sought t be divided and
which deed of conveyance to the said Nannie Hawn is dated the ____ day of
April, 1922, and redorded in the clerks office of Knox County in Deed Book
53 page 431 and ded to the said Nannie Hawn assigned and acknowledged by
the said Alice Golden and her husband I. H. Golden, Effie fuller and her
husband Thomas Fuller, and was acknowleged by the same James Hawnmand his
wife Georgia Hawn, but by inadertence and oversight the said James Hawn and
his wife Georgia Hawn failed to sign said deed and
WHEREAS, the said James Hawn departed this life intereste on the _____ day
of ______, 1923 and left surviving him the said Georgia Hawn, his widow and
the said Goble Hawn, Lewis Hawn Maymie Hawn and Maggie Hawn as his children
and only heirs at law, and.
WHEREAS, the said James Hawn has received a deed of conveyance to the
particular parcel of land allotted to hem in siad division, and the said
wido w and heirs of the said James Hawn, who are the parties of the first
part herin, desiring to carry out in full the conveyances to the said party
of the second part as undertaken in the adoresaid deed, dated April ____,
1922, recorded in the clerk's office of Knox county court, as aforesaid.
NOW THEREFORE, in consideration of the forgoing premises and one dollar
($1.00) the receipt of whis is hereby acknowledged the parties of the first
part hereby sell and convey to the party of the second part, heir heirs and
assigns, all the right title and interest of the said James Hawn, and which
deceased to the parties of the first part upon the death of the said James
Hawnm in and to the followin described tract of land situated in Knox
County, on Cumberland Rive, about three miles below Barbourville, and
bounded as follows:
Beginning at a large sycamoreo near the bank of the river and the corner
to Warfield, and running thence up the public road and with the middle
thereof to following courses and distances to-wit; N 69 1/2 W.22 3/4 poles;
N70 1/2 W 17 1/4 poles N 43 W. 18 poles N 24 W 8 1/2 poles N 60 3/4 W 3 3/4
poles; s. 82 3/4 W 12 1/4 poles N. 60 3/4 W 3 3/4 poles S 82 3/4 W24 1/4
poles N 60 3/4 W 3 3/4 poles S 82 3/4 poles N 71 W 12 poles N 2 1/2 W 5 1/4
poles N 123 1/2 E 18 poles N 35 W 8 1/2 poles N 70- E 16 1/2 poles N64 1/2
E 12 poles N 63 1/4 E 13 1/2 poles S 49 E 1 pole to a stake in James
Campbell line near a small cedar tree; thnce leaving therunning with said
Campbeel line S 47 E 26 poles to a dead walnut stump near 2 fork of the
branch; thence S 47 E 23 poles to the middle of the river; thence down
rever with its meanders to the beginning and containing, and fortytwo acres
(42).
TO HAVE AND TO HOLD THE SAM E, together with all the apputtenances
thereunto belonging unto the party of the second part, her heirs and
assigns forever, with convenat of general warranty.
The above described land was conveyed to Jacob Hawn by Rich Adams by deed
bearing dat 27th day of February, 1884 and is recorded in deed book K page
461 in the Knox county court clerks office.
IN TESTIMONY HEREOF, the partied of the first prt have hereunto subscribed
their names the day and year aforesaid.
