I am forwarding the following message I received in answer to some of my
questions about Owen Co Cementeries.
I am going to write the State Attorney General's office today, for info
about
registering the cementery -- and to find out if it might already be
registered.

This is the cemetery that is on the right hand side of the road as
you
are going to Carrollton. This small cemetery was originally part of the
Bethel Church that is no longer in existence. The cemetery belongs to no
one, but is connected to a farm. Donnie Beck Stafford owns some land in
back, and I'm not sure who owns the other farm to the back of this
cemetery. Cemeteries on private property do not and are not owned by the
farmer or land owner. The State Attorney General's law on this is that
if
you have a cemetery on your property, you are obligated to care for it,
to
see that it is maintained, and to have it fenced against damage from
livestock, this is never or rarely done and the Attorney General's office
doesn't follow through on conplaints but tries to encourage property
owners
of their responsibility.

To question one, no one owns this cemetery. It is the responsibility of
the descendants who care enough to maintain this cemetery. A part of
this
cemetery is currently being maintained by James Norton who has family
buried there. Several other families take care of their individual plots
there. Information on private cemeteries can be gotten from the State
Attorney General's office. This cemetery can be certified through the
State Attorney's office for a small fee and this will help it from being
totally destroyed in the future from road expansion, farm encrochment
etc.,
I encourage this to all who have families on or near private property.

Since this cemetery does not belong to a church or an organization like
Odd
Fellows, or Masons, she has the right to maintain her family plot and can
clean and clear it. If it was on private property, she just simply has
to
tell the farmer that she wishes to clear and clean her ancestorial
burying
ground and you do by law have the right to enter and leave at the closest
point of entry that does not damage the farm land or crop. Tom Towles
and
the Towles Clan just did a major clean up on Claxon Ridge of their
ancestorial burial grounds.

families
area.

Jackie Ogden of Sanders did have the equipment to erect toppled
tombstones
and also to repour cement to erect toppled or leaning tombstones. She
may
want to contact him.

We know of James Norton's family, and Jim said there are several other
families that are buried there, but they are maintaining their own plots.

James Norton lives in the Louisville area and he has a stepson who lives
in
Owen County, a Larry Goodrich, who lives in Gratz.

She should send the names to the Owen County Historical Society for
inclusion to their records on cemeteries within the county.
