I don't think the presence of "RE:" is a reliable test of spam/non-spam. A genuine attempted message to the list that is not a reply will not necessarily have "Re:", or any variation thereof, in the subject line.
I'm not saying that you *should* be seeing non-RE messages; but it is definitely *possible*. And if 98% is close enough for you, I think just ignoring all pending messages will accomplish that task. At least, it would for my lists.
I check the notification message to me to see if it looks even mildly interesting. If not, I sometimes go to pending messages and delete what's there (if I have nothing better to do with my time); or, just wait 14 days for it to die a natural death (usually).
