Will of Stephen E. Noyes of West Newbury, Essex
County, MA, file date 13 March 1893, transcribed from
microfilm of Essex County probate copybooks at
Massachusetts Archives, docket #73767, Volume 492,
pages 259-261 (volume and pages as numbered by the
Archives). A codicil follows the will. Other probate
documents, including inventories, exist but are not
included here. Punctuation, spelling, grammar, and
capitalization are as they appear on the microfilm.

In the name of God Amen. I Stephen E. Noyes, of West
Newbury, farmer, being now of sound and disposing
mind, but remembering the uncertainty of life and the
certainty of death do ordain and publish this my last
will and testament in manner and form following, viz:
First, I order all my just debts and funeral charges
to be paid by my Executor hereafter nam[ed.]
Item. I give and bequeath to my wife Lydia O. Noyes
two hundred dollars ($200.00) in money and the use and
improvement of that part that she may choose to take
of all my Books, Furniture, plate, beds and bedding
and linen during her natural life, likewise the use
and improvement of the westerly part of the house we
now occupy the passage to the garret and cellar to be
used in common by the people occupying both parts of
the house the building in the rear of the house for a
wood house; Two seats in the Pew in the Meeting House
where we now sit. The use of a horse and carriage to
go to meeting and on other occasions when she wishes
and one third (1/3) part of the income of the farm we
now occupy after the payment of the taxes on the same.
The above bequests in this Item are for her use and
comfort during her natural life.
Item. After the death of my wife Lydia O. Noyes I
give and bequeath to my son George E. Noyes and to my
daughters Jane K. Hoyt and Adalaide A. Flanders the
linen and silver plate that may be in the house the
same to be divided equal_ between them.
Item. I give, bequeath and devise to my wife Lydia O.
Noyes the income of all my real estate in Merrimac now
occupied by my daughter Adalaid A. Flanders and her
husband Moses C. Flanders during her natural life, and
at her decease I give bequeath and devise the same to
my daughter Jane K. Hoyt and to my son George E. Noyes
to be divided equal_ between them and their heirs and
assigns forever on the payment of five hundred dollars
($500.00) to my daughter Adalaid A. Flanders, of said
sum of money one half to be paid by George E. Noyes
and the other half by Jane K. Hoyt to the said Adalaid
A. Flanders.
Item. I give and bequeath to my daughter Jane K. Hoyt
to her and her heirs forever the sum of one thousand
dollars ($1000.00) to be paid by my executor hereafter
named within one year after my decease.
Item. I give bequeath and devise to my son George E.
Noyes the rest and residue of any estate both Real,
Personal, and mixed wherever th[___] may be situated
he to furnish my wife if she should outlive me with
the use of a horse and carriage to go to meeting or to
ride on other occasions likewise to pay my wife during
her natural life the one third part of income of the
farm where I now reside after the payment of all taxes
to him and his heirs forever.
Item. I hereby constitute and appoint my son George
E. Noyes sole Executor of this my last will and
testament and request that he shall not be required to
give bonds for the performance of said trust.
In testimony whereof I have hereunto set my hand and
seal and publish and disclose this to be my last Will
and testament in the presence of the witnesses named
below this twenty-second day of March, in the year of
our Lord one thousand eight hundred and eighty. The
words and silver plate interlined before signing.

Signed, sealed, published and declared by the said
Stephen E. Noyes as his will and testament in the
presence of us who in his presence and in the presence
of each other and at his request have subscribed our
names as witnesses thereto.

I, Stephen E. Noyes, of West Newbury, in the county of
Essex, and Commonwealth of Massachusetts, being of
sound and disposing mind and memory, do make this
codicil to my last will and testament within written.
Having sold the real estate mentioned in item third of
my said will thereby leaving no provision for my
daughter Adalaid A. Flanders, I make this codicil for
the purpose of providing for her, and I give and
bequeath to my son George E. Noyes the sum of one
thousand dollars in trust and confidence that he may
safely invest the same for the benefit of my said
daughter Adalaid A. Flanders and pay over the income
thereof annually to her and if necessary pay to her as
she may need from the principal always using his
discretion, and I request that he be not required to
furnish surety or sureties on his bond as such
trustee.
In testimony whereof I hereunto set my hand, and in
the presence of three witnesses declare this to be a
codicil to my last will, this tenth day of March A. D.

On this tenth day of March 1891. Stephen E. Noyes, of
West Newbury, in the Commonwealth of Massachusetts
signed the foregoing instrument in our presence
declaring it to be a codicil to his last will, and as
witnesses thereof we three do now at his request in
his presence, and in the presence of one another
hereto subscribe our names.
