First thing to do is check with the cemetery you want the stone placed in. Will they allow it? If so, then check with both cemetery's township/city/county/owner to see if there are any records need to be filed to remove and replace it legally.
Sometimes a cemetery may be on private property, but that doesn't make it part of the property. Try checking deeds and etc. to find out it's legal status. Suggest the other stones also be moved to a local cemetery or the cemetery they are in be given protection. If it is actually a cemetery, it should be fenced for it's protection from the surrounding landowner. Any stones in the area, should be returned to the area they were in.
If everything else fails, as long as your cemetery will allow the stone, I see nothing wrong with picking it up and taking it. I assume it is not actually set into the ground, that it is just laying there. Depending on the spite of the landowner, you might want notarized permission to take the stone, for your protection.
That's just my commonsense opinion, nothing known about the actual laws involved.

The first thing you should do is call the Texas County Sherrif and file a
complaint against the landowner. What he did is against the law.
