I HATE when developers think they can come in and walk over our buried dead
. . . whether military or not. I do not like to think that someday I could
have a sewer line running across my face for instance!!!! In MN we have
laws to protect cemeteries and I have just saved one from an invasion by a
farmer who moved a fence north about 32' cuz it looked too nice to have
anyone buried there!! MN State Archeologist gave me assistance and in
working with the county attorney where I live, to make a long story short .
. . he put the fence back and seeded it back in with grass!! The legal
description did not perfectly match and he was foolishly given advice by a
surveyor either to change the legal on the abstract OR remove the fence!!
Foolish man to practice law without a license, and it got the farmer in huge
trouble. He had a misdemeanor for moving the fence but a felony for plowing
up the land, all expunged upon return to original state. Old timers in the
area tell me that there were Indian battles and their dead were left,
neighbors buried them in the south section of the cemetery along with
unmarked graves there for those who died during the influenza outbreak and
typhoid epidemics as well. So though there were no longer markers on those
graves, may never have been, by our state law it was always recognized as a
cemetery, it had been fenced since the 1870s, so no doubt that it was a
cemetery and no man wants to mess with one here!! I pray you will find
resolution that is amicable to all concerned and most especially to those
suspected of trying to lie in peace in that ground!! Maybe a nice memorial
marker should be placed instead and develop property elsewhere!!!
