Last Will and Testament of Ernest E. Shaw, Deceased.
In the name of God, Amen.
I, Ernest E. Shaw, of Jefferson County, Mississippi, being above the age
of twenty-one years, of sound and disposing mind and memory, aware of the
uncertainties of life and the certainty of death, do hereby make, publish,
ordain and declare this to be my true and lawful Last Will and Testament,
hereby revoking all prior Wills or Codicils which I may have heretofore
executed.
Item One: As soon as practicable after my death it is my desire that all
my just debts be paid.
Item Two: It is my Will that I be buried in the Union Church Cemetery in
a steel casket or in a casket set in concrete; and that a suitable monument, to
cost not over $500.00, be erected at my grave.
Item Three: To Vernon Shaw, Purvis Shaw, Pete Shaw, Leta Shaw, Alma
Shaw, and Annie Shaw, being six of the children of my deceased brother, T. A.
Shaw, I hereby Will, devise and bequeath, as tenants in common, share and share
alike, all my right, title, and interest if every character and kind, in and to
the land left by my deceased sister, Mag Shaw, except only the Mag Shaw Home
Place which I have heretofore quit-claimed to Ab Shaw.
Item Four: To my cook, Mary Lehman, who has worked for me for many
years, in lieu of wages which she has allowed to accumulate and remain in my
hands for safekeeping, I hereby Will, devise and bequeath the sum of Six
Hundred ($600.00) Dollars in cash, and also the house and yard which she now
occupies, together with four acres of land South of said house, and an outlet
to the public road.
Item Five: It is my express desire that no descendant of my deceased
sister, Leila Shaw McCallum, or of my deceased brother, William Shaw, is to
receive any portion of my estate. I hereby, for reasons sufficient unto
myself, expressly and specifically disinherit each and every descendant or heir
of the brother and sister in this item named.
Item Six: All the rest, residue and remainder of my estate, and all
other property of every character and kind, real, personal or mixed, and
wheresoever situate, of which I may die seized and possessed, I do hereby Will,
devise and bequeath to Sidney T. Shaw of Newellton, Louisiana, hereby
constituting and making him my sole and universal residuary legatee.
Item Seven: I do hereby nominate, constitute, and appoint the said
Sidney T. Shaw of Newellton, Louisiana, Executor of this Will, and do hereby
waive the giving of any bond by him as such. I also waive inventory and
appraisement of my estate and I also waive the filing of any accounts, annual
or final in any Court. The said Sidney T. Shaw is to have entire charge of the
balance of said property and he may sell, mortgage, or dispose of same in the
same manner that he could use any other property belonging to him, and he need
not procure any order of Court therefore, nor shall he be required to execute
the statutory bond of a residuary legatee.
In witness whereof, I, Ernest E. Shaw, have hereunto set my hand and have
declared this to be my true and lawful Last Will and Testament in the presence
of Frank V. Davis and Marjorie T. Smith, subscribing witnesses, who, at my
request, and in my presence, and in the presence of each other, have signed
their names as such subscribing witnesses, this the 17th day of August, 1937.

We, Frank V. Davis and Marjorie T. Smith, subscribing witnesses, do hereby
certify that we saw Ernest E. Shaw sign his name to this instrument and heard
him declare same to be his true and lawful Last Will and Testament, that he was
then above the age of twenty-one years and of sound and disposing mind and
memory, and that we, at his request, and in his presence, and in the presence
of each other, have hereunto signed our names as subscribing witnesses.
This the 17th day of August 1937.

E. E. Shaw was also known as Ernest E. Shaw
E. E. Shaw died on April 5, 1940 in a hospital in Vicksburg, MS. He was buried
according to his wishes in the Union Church Cemetery.
