….The petition of Leroy McCearly (McCurley) and Eliza McCearly (McCurley) his
wife of said county shows that William Aswell departed this life sometime in
the year 1863 leaving no will that your petitioners know of…that at the time
of the death of said William Aswell he left your petitioner Eliza McCearly
(McCurley) as his widow who has since intermarried with said Leroy McCearly
(McCurley)…..
the said intestate to wit (left) minors William Aswell and Jane Aswell
