PERK Guilty - The second trial of Martin PERK, charged with burning the oil
warehouse, commenced Tuesday. The most of the day was consumed in procuring
a jury. Wednesday, Mr. A. B. HEMINGWAY, who was brought from the Jackson
prison to testify, was called, and upon being asked in regard to his
whereabouts the night of the oilhouse fire, addressed himself to the Court
as follows:
"Your Honor, heretofore I have always been a free and willing witness, and
henceforth I do not desire to say anything further which will tend to
criminate myself, and I ask the protection of the Court."
The Prosecutor then asked him several questions, but failed to gain any
information, and he was told to stand aside. Thursday afternoon, after the
other witnesses had been sworn, he changed his mind, and came forward and
gave his testimony. The jury came in about 6:30 last evening, after having
been out about thirty minutes, and returned a verdict of guilty. Mr.
HATHAWAY'S trial will likely engage the attention of the court the first of
next week. The case of The People vs. Edward EVANS for assault and battery,
was called this morning.
