I have a set of papers for my ggrandfather all from the Common Pleas
Court NYC.
1. Dated August 30, 1860, says: The said applicant appearing
personally in court, producing the evidence required by the Acts of
Congress, and having made such declaration and renunciation, and having
taken such oaths as are by the said Acts required, IT IS ORDERED by the
said Court, that the said applicant be admitted to be a Citizen of the
United States of America. (these are court orders recording the final
disposition of his citizenship)
2. Dated May 17th, 1958 says: I, William Phillips, do declare on oath,
that is is bona fide my Intention to become a CITIZEN of the UNITED
STATES, and to renounce for over all allegiance and fidelity of any
foreign Prince, Potentate, State or Sovereign whatever, and particularly
to the Queen of the Untied Kingdom of Great Britian and Ireland, of whom
I am a subject. (this is similar to what Edna's papers said) Under the
signature there is a statement: I Certify, that the foregoing is a true
copy of an original Declaration of Intention of record in my office,
signed by the City/county clerk.
3. the third page is the witness statement saying in part: "applicant
has resided within the United States for the continued term of five
years, at least, next preceding the present time, and within the State
of New York one year, at least immediately proceeding this application",
signed Aug. 30, 1860
What confuses me about the above paperwork, is that it is my
understanding that you did not get citizenship until 5 years after
filing your first papers (declaration of intention). I have been
thinking all along that they are petitions for citizenship with the oath
of allegiance and witness depositions. They were filed only two years
before he was granted citizenship, so it is my impression there was a
declaration of intention filed around 1855 but I haven't found it yet.
The letter I have from NARA that accompanied the documents called them,
"Petition of Naturalization".
Also in the letter, "NYC naturalization records (including Certificates
of Arrival and Declarations of Intention) filed prior to September 1906,
will not provide the applicant's date of birth, place of birth, the date
of arrival, or the name of the vessel. That information was never
recorded during that period of time.
