In the Name of God Amen I Josiah Howell of the Town of Southampton County of Suffolk ye Province of New York Blacksmith being sick in Body but of sound and perfect
mind and memory thanks be to God therefor but calling to mind the mortality of my Body and Knowing it is appointed for all Men once to die do make and ordain this my last Will
and Testament in manner and form following yt is to say principally and first of all I give and Recommend my Sole in the hands of God that gave it and my Body I commit to the
Earth to be decently buryed by my Exers hereafter named nothing doubting but at the General Resurrection I shall receive the same again by the mighty power of God and as
touching my temporal Estate and such Goods and Chattels as God hath given me I give and bestow in the following way and manner
first I will that all my just debts be paid by my Exers within convenient time after my decease
I give to my Son Abner and to his heirs and assigns for ever all that my uper close of Land at Hallseys neck and all that my northernmost close of Land at Seven ponds and also one half of my Meadow lying at North Sea and my Orchard at longsprings and one half of my Right in the lot of land No.
thirty seven in the great division both north and south side and also one sixth part of a Lot of Land in the twenty acre Division at the north side lying in the Lot with the Widow
Martha Hallsey and also one third of my Commonage between the Conew place and Easthampton bounds and also all that my Lot of Land lying between the Conoe place and
red creek on the North side of ?Iuaga path and also my Silver Tankard and Twenty Pounds to be paid to him out of my moveable Estate and all my Cole and my Mundrel and
my small Vice and Scrue to brich Guns with and also all that my right of Land with or lying in the Lot with David Fithen and Mr. Herick in Poyonquougeneck and also I give him all that my piece of Meadow at the Bottom of Hullsiesneck lying on the east side of the Ditch and also one third of my Right of Commonage westward of the Connew place all which I give to him his heirs and Assigns forever
2dly I give to my son Josiah all my lands meadows and Buildings which I have westward of a place called Tianah ...
Excepting one third of a Lot of meadow on the beech lying with my Son Elias I also give him one third of my Comonage threwout the bounds of the town and no more also I give
him all my Smiths tools except what I have given to Abner already also all my Iron and Steel all which I give to him his heirs and assigns forever
3rdly I give to my Son Elias all that my home Lott which I bought of Nathan Sayre with all the Buildings thereon
standing and also my Smiths Shop and also my Coopers neck Close of Land which I bought of Israel Howell and also all that my piece of Meadow and Land lying at the Bottom of Hallseys neck on the West side of the Ditch and all my Land at the Seven ponds except what I have mentioned to be given to Abner I also give him one sixth of a Lott of Land in the Great South Division No. thirty seven and all my right of Land in pougonquoge and one third of my right of Commonage threwout the Bounds of the Town and one half of a Fifty of Land in the twenty acre Division lying with the Widow Martha
Hallsey and half my meadow at North sea also one third of a Lott of Meadow on the Beach lying in a Lot with his own meadow all which I give to him his heirs and assigns for ever
4thly I give to my wife one third that is to say the use and improvement of one third of all my Lands Meadows Buildings and Comonage which shall be in Lieu of her Dowry I also give give her sixty pounds to be paid to her out of my moveable Estate in such things as she shall best like to take and also Six sheep and one Ox and one horse and three Cows and I also give her the use and improvement of my Negro man so long as she lives my Widow and no longer and after that my said Negro shall be my Son Eliases
5thly I give to my Daughter Anne sixty pound in money to be paid to her by my Exers out of my moveable Estate and also one Bed and furniture and if my said Daughter shall out live her mother or till her Mother be married then she my said Daughter shall have the use and improvement of my West Room in my now dwelling house and half the oven and half the
well as long as She lives unmarried and no longer
(6thly) I give my daughter Esther the use and Improvement of all that my house and Land in the Jerseys being in Morris County during her natural life and after her decease it shall be her Son Elias posts and it shall be to him his heirs and assigns for ever and I also give her five shillings
7thly I give to my two Daughters namely Phebe and Mary ten pounds apiece and my will further is that after all my just debts and Legacies as aboves are all paid and done then the remainder of my moveable Estate I give one half of it to my Son Elias and the other half to my Wife and my Daughter Anne to be equally Divided between them
(8thly) and Lastly I constitute apoint ordaine and make my Son Elias and my friend Abram Hallsey my only and Sole joynt Executors of this my last Will and Testament and I do hereby revoake disannul and make void all and every other Will Testament or Legacies by me at any time willed bequested or made before now Ratifying and Confirming this and none other to be my last Will and Testament In Witness whereof I have hereunto set too my hand and Seal in Southampton this eighth day of March in the twenty fifth year of the Reign of our Sovereign Lord George the second by the Grace of God of Great Britain France and Ireland King (.....)

Be it Remembered that on the day and year above written personally appeared before me Brinley Sylvester being thereunto delegated and appointed Elias Cooper and Jeremiah
Jaggar two of the witnesses to the within written Will of Josiah Howell and made Oath on the holy Evangelists of Almighty God that they saw the said Josiah Howell sign seal
publish and declare the same to be his last Will and Testament and at the times thereof he was of sound and disposing mind and memory to the best of their understanding.

George Clinton Esq. Captain General and Governour in Chief of the Province of New York and territories thereon depending in America Vice Admiral of the same and Admiral of the White Squadron of his Majesty’s Fleet To all to whom these presents shall come or may concern Greeting Know Ye that at Suffolk County on the twenty fifth day of May last before Brinley Sylvester Esq. being thereunto delegated and appointed the last Will and Testament of Josiah Howell deceased a copy whereof is hereunto annexed was proved and now approved and allowed of by me the said Deceased having whilst he lived and at the time of his Death Goods Chattels and Credits within this province by means whereof the proving and Registering the said Will and the Granting Administration of all and Singular the said Goods Chattels and Credits and also the auditing allowing and final discharging the accompt thereof doth belong unto me And that administration of all and Singular the Goods Chattels and Cr!
edits of the said deceased and any way concerning his Will was Granted unto Elias Howell and Abram Hallsey the Executors in the said Will named being first sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and Singular the said Goods Chattels and Credits and also to render a just and true accompt thereof when thereunto lawfully requested In Testimony whereof I have caused the Prerogatives Seal of the province of New York to be hereunto affixed this twenty eighth day of July one thousand Seven hundred and fifty two.
