I Charles Elliott of the County of Knox and State of Ohio
do make and publish this my last Will and Testament in manner
and form following Viz.
1st It is my will that my just debts and funeral expences be
fully paid
2nd It is my will that my household furniture bedds and
bedding be equally divided between my three daughters Nancy
Dugan? Mary McWilliams and Eleanor McKee except as hereinafter
excepted
3rd it is my will that my son Robert Elliott have my clothes
cupboard and three pieces of thick cloth viz. one gray piece one
black piece and one drab pice and two pieces of white flannel
and all my wearing apparel
4th It is my will that my son Hugh Elliott have the privilage of
presenting his account against my Estate to my Executor without
any legal proof and be excepted by said Exacutor as a just
demand against said Estate for maintaining and nursing? my
deceased Wife and myself in our last sickness.
5th It is my will that my daughter-in-law Rachel Elliott be paid
by my Executor the sum of thirty dollars
6th It is my will that all the balance of my Estate be it
whatever nature it may be equally divided between my four sons
Hugh Elliott James Elliott Charles Elliott Andrew Elliott and
Rachel W? Elliott and my three daughters Nancy Dugan? Mary
McWilliams and Eleanor McKee and my Son William Elliott's four
children Simon Elliott Jacob Elliott Mary Ann Elliott and Charles
Elliott the four last named to be estimated as one heir=20
7th I do hereby constitute and apoint my son James Elliott
Trustee in trust for my four Grandchildren Simon Elliott Jacob
Elliott Mary Ann Elliott and Charles Elliott to dispose of their
several legacies as he shall trust most prudent until they
shall come of the age of eighteen and twenty one respectively
8th and lastly I do hereby constitute and apppoint my son James
Elliott the Executor of this my last Will and Testament
In Witness whereof I have hereunto set my hand and seal this 12th
day of December 1833
