If a company offers consumer services (primarily family, household, etc)
in Ohio, accepts any money, and fails to deliver or offer a refund
within a certain period of time (I think 6 weeks), then the company is
liable for 3 times actual damages or $200, whichever is greater, plus
attorney fees if the violation was "willful". This is under the Ohio
Consumer Sales Practices Act (Ohio Revised Code Section 1345.01, et
seq.; and administrative rules). So if you have to go to small claims
court, keep that in mind. If the service was not offered in Ohio, no
worry -- practically ever other state now has a consumer law that offers
a similar recovery.
If you are doing the genealogy for yourself or your family (not for
profit), then you probably have rights under the consumer law.
