Ffrancis Smith Senior -- Defend
in an Action of ye Case they Joyne Issue by concent without arrest or
sumons)
The names of ye Jury: Richard Crosby, John Mendinghall, Edward Pritchard,
Anthoney Weaver, John Child, Caleb Pusey, William Cloud, Edward Walker, Peter
Baynton, Joseph Baker, Joseph Richards, Thomas Colborne.
The declaration was read wherein the plaintifes declareth for 239:12:2-1/2
due by account for settling the Defendants Plantation att Chichester & the
Stocke thereon.
A letter was read from ffrancis Smith defent to his Daughter Ann Smith
Plaintife bearing date Lammas day 84; directing her to John Buckly for Advice
John Buckley being legally Attested declareth that ffrancis Smith said to
him that he had sent men servants by his sonne ffrancis & desired the
deponent that when he came over he should Incourage his Sonne Eyre and his
sonne ffrancis to goe on with ye Plantation lovingly together And that when
he came over he would Indevour to Settle them to their Content and ye first
that made the Diufference should fare the worse for it when he Came.
A letter was read from thge Defendt ffrancis Smith to ye other Plt Robert
Eyre dated July 24th 84, Importing his good liking of ye Plaintifs Building
on his land as also directing him for advice to the said Bucklin.
The Plaintifs account was read over in Court Article after Article
amounting to ye aforesaid sum of 239:12:2-1/2 another letter was read
Directed to John Beasar from ;ye Defendt dated 1st day of May 84.
The Defendt by his answer utterly denyeth and disowneth all
the 1st of ye 4th moneth 86.
The verdickt of ye Jury in the Cause depending between Robert Eyre and Anne
his wife Plt and ffrancis Smith Defendt after due Examination of each of
their accounts And Papers wee finds for ye Plaintifs 150 pounds and Cost of
Suite.
All goods Cattle and utensells of Household stuffe of ye Plaintifs now in
the Defend Custody is to be Properly and Intirely the Defendts owne.
The Judgement of ye Court is they do approve of ye verdickt of ye Jury and
Esteeme it resonable."
