DELAWARE COUNTY, SS. - At a Court of Common Pleas held at Media in and for
said County, the 25th day of June, Anno Domini, 1866, before the Honorable
William Butler and his Associates Justices of said Court: The petition of
Joshua P. Eyre, Joshua P. Eyre, Jr., and Caleb C. Eyre, Wm. P. Eyre and
Rebecca C. Eyre, the last three minors by their Guardian Joshua P. Eyre was
presented respectfully representing: That on the 24th day
of June, A.D., 1799, << Jonas Eyre>> , executed and delivered to Aaron
Musgrave a mortgage on a tract of land, situate in the Borough of Chester
(now City of Chester) on the east side of Essex street, or Concord road,
and on the west side of Chester Creek, beginning at the said Creek in the
line of Valentine Weaverlot, thence in the line of the same S 66 deg. W 61
perches to a post by Essex st., or Concord road, a corner of said Weaver's
lot, thence by the said road or street, N. 57, W 10 perches to a post,
thence N 66, E 77 perches (running in part by Samuel Worrall's Land) to
Chester creek, thence down the said creek 12 1/2 perches to the place of
beginning, containing three acres and ninety nine square perches, for
securing the payment of the sum of 35 pounds, 2 shillings and 8 pence, on
the 24th day of June next ensuing the date of said mortgage with lawful
interest and also the sum of 35 pounds, 2 shillings and 8 pence at or
immediately after the death of Elizabeth Price, widow of Elisha Price, late
of said Borough, deceased, with lawful interest annually thereon, which
mortgage is recorded in the Office for recording Deeds, &c., in and for
said County in Mortgage Book 'A.'That the said Elizabeth Price died
sometime in the year 1840. That the said Aaron Musgrave being the legal
holder of said mortgage has died without entering satisfaction upon the
record of the same, and that payment has been made of all the moneys or
amount due thereon, and has so continued for more that two years, and that
said petitioners are the owners of the aforesaid mortgaged premises, or the
greater part thereof, and that there are no legal representatives of the
said Aaron Musgrave living in said county, and that Elizabeth Pennell, wife
of Edmund Pennell is the only legal representative of said Elisha Price
residing in said County. Therefore praying the Court to direct the Sheriff
to serve notice stating the facts set forth in said petition on Elizabeth
Pennell, and also to give public notice as aforesaid, to the legal
representatives of said Aaron Musgrave and Elisha Price in one of the
newspapers within said County agreeably to the Act of Assembly of
Pennsylvania in such case made and provided, requiring them to appear at
the next term of said Court and answer said petition, and to show cause if
any they have why this Court upon due proof being made shall not direct
satisfaction to be entered on the record of said mortgage by the Recorder
of Deeds of said County. Whereupon it is hereby ordered and declared that
the Sheriff of said County serve a notice stating the facts set forth in
said petition on the parties interested requiring them to appear at the
next term of this Court and answer said petition if they be found in said
County; and in case of all the parties aforesaid cannot be found in said
County, then the Sheriff shall give notice as aforesaid in the 'Delaware
County American,'a newspaper published in said County once a week for four
successive weeks prior to the fourth Monday of August next requiring said
parties to appear at said time to answer said petition. By the Court.
