An interesting court case. If you have the patience to read through it,
here is the url:
http://www.courtinfo.ca.gov/opinions/documents/B163347.DOC
If you have no patience, here is the short version. Parishioners
(Plaintiffs Guardian Angel Parish), for various reasons, via an illegal
board, voted to sever ties with the PNC. They did some other things such
as attempting to keep PNC members out who did not want to sever ties.
They brought suit to confirm the real property to themselves, among
other things. The bishop of the PNC and the PNC in Scranton were
defendants. They contended the actions by the illegal board were null,
and that the constitution and bylaws of the church mandated that the
trial court find for defendants. The trial court found for plaintiffs
and defendants appealed.
The appellate court agreed with defendants and reversed with directions
to the Superior court to change the judgment in defendants' favor.
