Elizabeth Elmore by next friend Jacob Elmore vs. S. B. Burket, John J. Cox.
Bill for Injunction and Relief filed 2 Jan.1853. Oratrix Elizabeth Elmore,
wife of Francis Elmore, by next friend Jacob Elmore shows that George Cox,
father of the oratrix, died intestate leaving a large estate. Upon
distribution oratrix was allotted by Court of Equity of Marion Dist. 275
acres as her share. Having had issue by her husband Francis Elmore, he
became
tenant in common. He has suffered land to be sold by sheriff. Oratrix
claims she is entitled to be protected in her inheritance. Answers by
defts.: Francis Elmore went into possession of land in 1811 and from that
time until purchase by Timmons and for several years afterwards resided on
lands and claimed same. George Cox was father of Elizabeth Elmore. Bill
for
Partition: P. O. Cusack and Ann Cox vs. Jacob Cox et al (Extract from Return
of Commissioners): To Elizabeth Elmore, wife of Francis Elmore, we have set
apart 2 negroes named Jennet and Rose....and 270 acres on Lynches Creek,
being land on which he now resides., reference to plat made by E. D.
Singletary dated 23 May 1845. Arrick Coward's testimonry: Elmore and wife
lived on place in 1816-17; moved 1821-22; returned in 1829. No one lived on
land in 1824. (Note: Francis Elmore lived in Williamsburg Dist. during
portions of these times).
