I seem to have inadvertently started something with Habeas Corpus. I did not
think about the habeas bit; I was focussing on the corpus.

I suppose that habeas is in the subjunctive mood to give a conditional
flavour. "If you have a body ..." or "Should you have a body...".
Presumably it is open to the person to whom the writ is addressed to respond
by pleading that he is not holding the person named in the writ a prisoner.
