Will of Samuel Berkey (5/7/1817-4/12/1896)
In the name of God Amen: I Samuel Berkey of Lincoln Township, Somerset
County, PA., being in good health of body and sound mind and disposing
memory "praise to God for the same", make and publish this my last will and
testament. To such worldly estate wherewith it has pleased God to entrust
to me, I dispose of the items of the same in the following:
1.. I will my household goods shall be appraised, after appraisement shall
be sold at public sale, except such articles of furniture that my wife
Elizabeth [Swank] (7/19/1817-10/1/1897) may select.
2.. My will is that my wife Elizabeth shall have 1/3 of my estate as the
law provides dowry to be left in real estate during her natural life.
3.. My will is that my daughter Catherine (5/28/1857-3/15/1914) shall have
the old "Homestead" at the appraisement value, containing 148 acres.
4.. My will and desire is that my son Levi (June 30, 1848 - June 11, 1921)
shall have the 75 acres tract at the appraised price.
5.. My will is that my executors herein named shall appoint three
competent men who after being duly sworn shall appraise the two tracts of
land above described at cash value.
6.. Should any of my children above named not accept the land at the
appraisement then my executors shall sell the same either at public or
private sale.
7.. My will and desire is that my widow shall have the use of the house on
the old "Homestead" in which we now live during her natural life, free of
charge.
8.. On February 21, 1894 when I deliver the deed to my son Abram S. Berkey
(December 08, 1850- May 23, 1928) for the 109 acres conveyed to him, he gave
me a note of $636 for balance of purchase money, said note to be charged up
to him as part of his share.
9.. I hereby constitute and appoint my friend J. Harry Fritz and my son
Levi Berkey to be my executors of this my last will and Testament.
10.. My legal heirs are Levi Berkey, Abram S. Berkey and my daughter
Catherine married to George Cover.
In witness where of I have hereunto set my hand and seal this 7th day of
March 1894.
