Hallo Pat and Heather
Any person who has a direct interest in the file is entitled to have access
to the information in the file. The Promotion of Access to Information Act,
Act 2 of 2000 provides that a Requester may authorise another person to make
a request on his behalf.
The Human Rights Commission has ruled as follows in this regard:
"..............the answer is that section 18(2)(f) presupposes that a person
may authorize another person to make a request on his behalf. Section 1
under the definition of a requester provides that a person may request on
behalf of another person. These two sections presupposes that the
Information Officer is obliged to give the requested information to the
requester (authorized requester who is acting on behalf of another person)
................."
The person authorised by the requester does not have to be a social worker
or an Attorney - if any one of the Barnett Children need access to the
information they could appoint a researcher in Bloemfontein to access the
file - the authorisation must clearly state that it is being done in terms
of the provisions of Act 2 of 2000.
