You are misinterpreting the use of the Witness function in tags. A witness
in a tag doesn't need to be a 'witness' in the legal sense. A witness is
simply any person associated with the event in question. A surviving spouse
is surely associated with the death of his/her spouse. Adding the surviving
spouse to the Death tag is a simple mechanism to create a sentence for that
spouse without the need to resort to an additional and unnecessary, in this
case, custom tag type.
