Well Elinore, I've looked all over, but cannot find those pension papers.
However, I had earlier copied a little of the data down into my laptop
computer. I wish I could find the entire file for you, but maybe this will
help some. She did not name any of her children except William HAYS in
these papers. I have one Nathaniel HAYS in my files: son of Charles and
Elizabeth ADKINS HAYS of Smith Co., TN who had married in Montgomery Co.,
VA 05 Aug 1788. My notes on Samuel HAYES:
Alsey HAYS, a widow, lives in Rutherford Co., TN in 1820, 5 years after
the death of her husband, Samuel HAYS, house #81: 1m18-20, 1f26-45, 2m
under 10, 1 m 10-16, 1m 16-18, 1f under 10, 1f 10-16. Alsey would be about
41 years of age in 1820. She is also on the 1850 Wilson Co., TN census,
age 67 b. c1783 NC. Her husband was the Samuel HAYS who served in the War
of 1812. He may also be the Samuel HAYS listed in Granville Co., NC on
the 1810 census, page 876 or page 909. From the War of 1812 pension request
papers comes the dates/places of her marriage and his death date/place.
He died from an unknown illness suffered during the war. He served in the
TN State Militia (Volunteers) as a private under Capt. Nance. His widow
signed papers from DeKalb Co., TN on 06 Aug 1859, saying she was 80 years
of age. She moved to Smithville, Dekalb Co., TN in March 1854. Under a
new pension law, she was reapplying for widow's benefits she had claimed
while living in the county of Wilson TN. Since the 1855 law, she had been
receiving $3.50 a month. By 07 Dec 1863, she filed new papers from Gibson
Co., IN. The widow had moved to Indiana in order to get away from the Civil
War problems. She had moved in with her son William HAYS, who had taken
the Oathe of Allegiance and moved to Gibson Co., IN. She stated that she
had lived with him for the last 30 years. She had been infirm during the
Civil War and stated she would have moved away sooner..."I should have
been glad to have done so sooner than I did - I have always been loyal
in my sentiments and feelings and have never either by word or act given
countenance or aid to this wicked Rebellion".

Ellis Hays returned inventory to the Rutherford Co., TN court. Is Ellis
a brother to Samuel, or is this a mis-spelling for Alcey, his wife?
