The law required that he serve only in the county of his "domicile"; that may be different than "residence". If you have a house in 2 counties, your domicile is the one you know as "home." That said, be aware that were one planning to move and had that established residence in that foreign county likely could disavow his domicile in the other county and serve. Were I you, I would check the tax lists, and deed records for the succeeding months to locate any sale or disposition of either tract, thereby indicating he had made his "home" in one or the other county. Paul, a question if I may. I am attempting to distinguish between two men,
Thomas Luton, both bearing the same name and alive at the same time.
If a person owns property in both Chowan and Bertie Co NC and his residence
is proven to be in Chowan would he be on a jury in Bertie as a result of
property ownership? Would he be called for jury duty even though his
residence was in the adjoining county? Dixie
