Hi,
Can anyone on this list help with any more information on John Spencer
and Benjamin James, still need parents of both.

COCKE TO JAMES: Whereas John Spencer did on the 27th day of April
eighteen hundred and five, purchase from me, what I then considered my
interest in one third part of a large tract of land, said to contain more
than two thousand acres, lying in the County of Loudoun near the Gum
Spring, and originally granted to my grandfather Catesby Cocke, who left
three children, John C. Cocke, William Cocke, and Elizabeth Cocke, and he
for my interest in one third part of the land desived under the will of
my Father William Cocke, agreed to pay to me the sum of two hundred and
fifty dollars, twelve months after date, and did on the said seventeenth
day of April 1805 execute his note with his son-in-law Benjamin James as
his security whereby he promised to pay to me, my heirs ---- the said sum
of two hundred and fifty dollars twelve months after date, and I on the
same date bound myself , heirs ---- by a written and sealed instrument,
to convey to him the said JOhn Spencer; all my rights title and interest
in & to one third part of the said land which he should pay to me the
said two hundred and fifty dollars, which he had stipulated by his note
to pay in the month of April Eighteen hundred and six the said John
Spencer soon after left Loudoun County as I understand & died some where
in the western part of Virginia, without paying any part of the money due
on his note & Benjamin James his security paid the sun stipulated to be
paid by the said note to Cuthbert Powell Esqr. by my direction, and claim
the conveyance of my interest in the third part of the land afore said,
stating that my title bond has been lost or mislaid and never put on
record, now I the said Washington Cocke having recd. the full amount of
two hundred and fifty dollars from the said Benjamin James agreed on for
my interest any recourse against me or my heirs for defect of title in
any manner, do hereby sell,
transfer and convey unto him the said Benjamin James and his heirs
forever all my right title and interest ( without future responsibility)
in and to one third part of the land aforesaid described as patented to
Catesby Cocke, and lying in the County of Loudoun near the Gum Spring and
do hereby covenant for myself and heirs to warrant and defend unto him
the said Benjamin James and his heirs the title herby conveyed, against
the claims of all persons deriving title from me, excepting the heirs of
the said John Spencer herein before named, with distinct understanding
that I am only selling an interest existing in law or equity and
transferred to the said James such right or title in and to one third
part of the land herein before described as I may have under the will of
my decd. father William Cocke and that I am neither directly nor
indirectly to incur any cost, or charges in relation to the property
hereby conveyed - In witness of the premises I the said Washington Cocke
have hereunto to subscribe my name , and annexed my seal this ninth day
of April Eighteen hundred & Thirty -

Clerk Office October 11th 1830 this Indenture was this day
proved by the oath of Wm Chilton & Wm K. Ish and on another day to with
February 14th was fully proved by the oath of Horace Luckett before me in
Office aforesaid & admitted to record
