Dear WRG:

The news in the attached post is most distressing. Do we have any WRG members
who live in Illinois who can check this out for us and report on the extent to
which it applies to genealogical researchers. One paragraph says "public
records", which would be literally anything in the court house - Probate, Land
Records, Guardianship, etc, much less the matter of Vital Records like Birth,
Death and Marriage. Another paragraph refers to "information relating to the
identity or whereabouts of any person."
This does not say, but might be interpreted to imply "living person", as the
dead do have whereabouts that should be outside the purview of the "State".

If this indeed does actually restrict research, then I think we need to find
ways to mount a major campaign to get the law repealed. I have a number of
friends in the academic community in Illinois, and I can't believe that one of
them has not alerted me to this if it actually does apply.

Hope we get a report soon.

Allan

Hi Tracey,

Sorry to be off subject (humour), but this is Genealogy related.

From: The Florida Genealogist, Vol XX, #3, Summer 1997

The Illinois state legislature recently passed an act restricting access
to public records only to those with a Private Investigators's license.
The current interpretation means that a genealogist, regardless of where
they reside or work, must have a Private Investigator's license before
requesting birth, marriage, death, obituary or estate records.

A private investigator is defined as any person, who for a fee or other
valuable consideration, engages in the business of obtaining information
relating to the identity or whereabouts of any person. Anyone obtaining
information for genealogical purposes is not exempt from the regulation.

The Illinois government web site is:

happy hunting
Donna
